Grandparents’ Rights in Naples

Individualized Guidance for Grandparent Visitation

Florida gives grandparents only narrow pathways to obtain court-ordered visitation, so the circumstances affecting each parent and child require careful review. Law Offices of Lisa P. Kirby helps grandparents understand the applicable legal issues and make informed decisions about how to proceed.

We have served clients in family-law-related matters since 1999, focusing exclusively on family law and divorce. As a solo practitioner law firm, we provide responsive, individualized attention and take the time to understand each client’s relationships, concerns, and goals.

Who May Seek Grandparent Visitation in Florida?

Florida law doesn’t give grandparents an automatic right to visitation. Under Florida Statute 752.011, a grandparent may petition when both of the child’s parents are deceased, missing, or in a persistent vegetative state. A petition may also be available when one parent meets one of those conditions and the other has been convicted of a qualifying felony or violent offense that poses a substantial threat to the child.

The Markel Act, enacted in 2022, addresses a separate and especially serious circumstance. It creates a presumption favoring reasonable visitation for a qualifying grandparent or stepgrandparent when one parent has been found criminally liable for the other parent’s death or civilly liable for an intentional tort that caused the death. The presumption doesn’t apply when visitation wouldn’t serve the child’s best interests.

Eligibility to file is only the first issue. Courts must also respect a fit parent’s authority to make decisions concerning the child, which is why Florida imposes demanding standards as the case progresses.

Visitation & Custody Involve Different Legal Questions

Visitation concerns court-ordered contact between a grandparent and grandchild. Custody concerns legal authority and responsibility for the child’s care and decisions. A request for time with a child therefore isn’t interchangeable with a request to assume responsibility for that child.

The legal questions may also change depending on whether the child remains in parental custody, has been removed from a parent’s custody, or is involved in an adoption proceeding. The child’s current living arrangement, the circumstances affecting each parent, and the history of family relationships are material to evaluating the available options.

Discuss Your Family’s Circumstances Confidentially

A consultation allows you to explain what has happened, identify the legal questions involved, and understand whether Florida’s visitation requirements may apply. We provide caring, straightforward guidance tailored to your family’s circumstances.

Confidential consultations can be scheduled by phone or through our contact form. We listen closely, explain the relevant standards, and discuss possible next steps without predicting how a court may rule.
